I William Magee of Warren Co. and state of Kentucky etc.
I will and bequeath unto my beloved wife SALLY the use and benefit of all lands and property during her life or such time as is hereafter mentioned and all other property to use and disppose of at her pleasure for her self and family.
Secondly, I will and bequeath unto my daughter NANCY, fifty acres of land which she is to have now taken off of the upper side of the tract that I now live on, but if fifty acres can't be got without taking more cleared land than the little field, she is then to run into the new survey for complement.
Thirdly, I will and bequeath unto my daughter SALLY so soon as she shall go to herself, off of the lower side of said tract. ( this is where I believe we have something left out)
Fourthly, I will and bequeath unto my son ANDREW Magee so soon as he shall come of age the lower plantation and the fifty acres that I bought off Sinos Greer's tract.
Fifthly and lastly I will and bequeath unto my son WILLIAM Magee at his mother's death or the end of her widowhood after he comes of age the balance of my lands.
Given from under my hand and seal the 24th day of March 1814 and I request my wife and her brother WILLIAM LOWE to execute the same.

In this will Benjamin bequeaths his 4 sons Crafford (Crawford) MeGhee,Shem'l (Shemuel) McGhee,Banks MeGhee,Claborn MeGhee to have the land I now live on to share and share alike and Equally divided and to Claborn MeGhee to have the lott including the house that I now live in Reserving my wife her Life in the part allotted to Claborn.

I give and bequeath unto "heirs" of my son Charles MeGhee five Shillings.I give and bequeath unto "heirs" of my son Benjamin MeGhee five Shillings. I also Give and Beq. to son Joseph five shillings. And to dau Sarah Griffin five shillings also my dau Haymon five shillings and to Ann Guerrot

To Lucy MeGhee and to my dau Mary Cook five shillings. Also my dau Penelope MeGhee five Sh. and to my dau HUTTZ DUKE five Sh.

In the name of God, Amen. I, Edward McGehee of Cumberland County being in my perfect sences and memory do make this my last will and testament as followeth.

Item I give to my son John McGehee and his heirs the following slaves Doll Sol Darkus Ben Lucy Minor and Judy together with their increase which slaves he now has in his possession. I likewise give to my son John and his heirs forever seven hundred acres of land lying in Prince Edward county joyning the land of Jacob McGehee, Sim Cock Cannon and George Walton.

Item I give to my daughter, Mary Hodnett, five shillings current money.

Item I give to my daughter Elizabeth Wright one negro wench named Hannah and her child Moses together with her increase to her and her heirs forever. I likewise give to my daughter Elizabeth Wright four hundred acres land being part of the tract whereon I now live and joining the land of Thomas Wright, Charles Lee, and Frances Apperson to her and her heirs forever.

I give to my son-in-law, Thomas Wright, one half of my water grist mill. I likewise give to my said son-in-law, Thomas Wright, one half of the land that I purchased joyning the mill to him and his heirs forever.

Item I give to my son, Micajah McGehee, one negro man named Bob to him and his heirs forever. I likewise give to my son, Micajah, seven hundred acres land in Prince Edward county being the land he now lives joining the land of John Martin to him and his heirs forever.

Item I give to my son, Mumford McGehee, one negro boy named Peter to him and his heirs. I likewise give to my son, Mumford, seven hundred acres of land in Prince Edward county being laid off in a lot as will appear by plot number one being the land whereon he now lives to him and his heirs forever.

Item I give to my son, Daniel McGehee, one negro boy named Ned to him and his heirs. I likewise give to my son Daniel seven hundred acres of land in Prince Edward county being laid off in a lot as will appear by a plot number two to him and his heirs forever.

Item I give to my son, Willliam McGehee, one negro boy named George to him and his heirs. I likewise give to my son William seven hundred acres of land in Prince Edward county being laid off in a lot as will appear by a plot number three to him and his heirs forever. I give to my son William two cows and calves and one feather bed and furniture.

Item I give to my son, Jacob McGehee, one negro boy named Tom to him and his heirs forever. I likewise give to my siad son Jacob seven hundred acres of land in Prince Edward county being laid off in a lot as will appear by a plot number six to him and his heirs forever. I give to my son Jacob two cows and calves and one feather bed and furniture.

Iem I give to my son, Samuel McGehee, one negro boy named Pompy to him and his heirs forever. I give to my said son Samuel and his heirs forever seven hundred acres of land in Prince Edward county being laid off in a lot as will appear by a plot number four. I give to my son Samuel two cows and calves and one feather bed and furniture.

I give to my daughter, Anna McGehee, one negro girl named Rachel with her incerase to her and her heirs forever. I likewise give to my daughter Anna four hundred acres of land being part of the tract whereon I now live joyning my mill to her and her heirs forever, but in case my wife should want any timber on the said four hundred acres land or to tend any part thereof during her live my desire is that she may not be prevented.

Item I lend to my beloved wife, Elizabeth McGehee, the land and plantation whereon I now live with four hundred acres likewise the following slaves Seasor London Sampson Bristol Jean Lucy Henry Dick Agg Jessee and the one half of the profits of my grist mill with the reaminder of my stock and household goods working tools & c. that's on my plantation during her natural life and my desire is after my wife's decease that the land whereon I now live may be equally divided between my two daughters Elizabeth Wright & my daughter Anna to them and their heirs forever. And further my desire is that after the death of my wife Elizabeth that one half of the mill and the remainder of my household goods & stock with the above slaves lent may be sold by my executors to the highest bidders and seventy five pounds sixteen shillings and eight pence to be paid to my son Jacob McGehee, and th___ pounds sixteen shillings & eight pence to be paid to my son Daniel McGehee also nine pounds three shillings & four pence to be paid to my son William McGehee. And my desire is that after the above cash is paid to my three sons that the balance may be equally divided between my daughter Elizabeth Wright and my six sons Micajah Mumford Daniel William Jacob and Samuel and my daughter Anna. And my desire is that there be no appraisement of my estate nor security given and further my will and desire is that in case either of my six sons or my daughter Anna should dye before they arive to the age of twenty one years or marry's that their part be equally divided among the remainder of the last mentioned children and lstly I do appoint my beloved wife Elizabeth McGehee, son Mumford, my son-in-law Thomas Wright and Henry Macon executors of this my last will & testament. In witness whereof I have hereunto set my hand and seal this 4th Apr 1770.

Know all men that I Fountain McGehee of the County and State a foresaid being of good intelect and of proper disposing capacity but weak in body indicating a probable departure of this life do make and ordain this my last Will & Testament.

First - I do by these presents request nominate and appoint my beloved wife Cynthia McGehee Executrix to this my last Will & Testament and after paying my just debts she shall hold and enjoy the remainder of my Estate (viz) lands and tenements negroes household & kitchen furniture horses & mules Cattle hogs - goods & chattels of every description moneys Notes and dues of every description to have to hold and enjoy the same in right of herself during her natural life of widowhood and after her death my whole Estate to be inherited by my infant son William Livingston McGehee and it is my wish and desire that if my Executors should think it to the interest of the Estate at any time to dispose of the whole or any part of the landed property she hereby has full power to make sale either privately or publicly of the same and convey titles and I do further request that my Brother John C.McGehee of desoto County, Mississippi and William Thompson of Fayette County Tenn. shall aid my Executrix in the administration and I do hereby make null and void all other Wills heretofore made by me.

In testimony of the soundness of my intentions in the devise made above I have hereunto set my hand and affixed my seal the day and date above written in presents of subscribing witnesses.

This is my last Will and Testament. I do hereby will and bequeath to my wife, Juanah L. McGehee all the household furniture in the East Room consisting of two beds and bedsteads and furniture, one bureau, two trunks and stand, chairs , also the table and kitchen furniture. The furniture that my daughter, Elizabeth Cowan had when she kept house. I desire that she may still all own it. The 80 acres of land that my son in law, E. D. Brown and Dellin (Dellia) Brown, his wife, now reside on, I will and bequeath to them to have and to hold forever, the above land being the South 1/2 of the North West 1/4 in T 7 N R & E. I also will to my daughter, Louisa M. McGehee, the North 1/2 of the South West 1/4 in the T 7 N R & E; I also will and bequeath to my son, Shadrick J. McGehee to hold and to have forever, the North 1/2 of the North East 1/4 in T 7 North of R 7 E; I also will to my son, Joseph A. McGehee to hold and to have forever the North East 1/4 in T 7 N of R 7 E, all of the above divided lands are in Section 12. The 80 acres of land that I now reside on, I will and bequeath to my wife, Juanah L.McGehee to hold and to have forever being the East 1/2 of the North West 1/2 of Section 11 G 7 South R 6 E;, I also will and bequeath to my grandson, George A. Cowan to hold and to have forever the West 1/2 of the North East 1/4 in Section 11 G 7 North R 6 E; yet I reserve for the benefit of my wife, the Plantation _______ so long as she may remain my widow: I also will to my wife Juanah L. McGehee, two cows and calves, and a heifer that will have a calf sometime during the summer known to the family, the balance of my barn stock, I wish equally divided among my seven children. Of the monies that are coming to me, the first that is collected or as soon as there is much collected as well, pay off all my debts. I want it done. I also will and bequeath to my son in law, George T. Riley, three hundred and thirteen dollars when collected after my debts are paid, a remainder in place of land, one hundred dollars in place of a horse; I also will and bequeath to my son, Jas. H. McGehee, four hundred and fifty dollars in place of land, and twenty four dollars with what he is owing me, which is twenty-six dollars, in place of a bed. I want E. D. Brown to have one hundred dollars, taking out of it what he owes me, which I hold the note for in place of a horse. I also want Louisa M. McGehee to have fifty dollars in place of a bedI want Shadrick J. McGehee to have fifty dollars in place of a bed, also want Joseph A. McGehee to have fifty dollars in place of a bed the balance of the money that is coming to me, I wish equally divided between my wife and children. I also will to my wife, Juanah L. I, Micajah MCGEHEE of the County of Oglethorpe and State of Georgia being weak in body but in perfect mind and memory, taking into view the uncertainty of life and the certainty of death, do make constitute and appoint Thomas MCGEHEE and Abner MCGEHEE my true and lawful Executors to do and perform this my last Will and Testament in manner and form following (Viz) I give and recomment my soul into the hands of Almight God who gave it, and my body to be decently buried.

Item. 1st. I do give and bequeath unto my affectionate wife, Ann MCGEHEE twenty five hundred dollars which is to be entirely at her disposal during her life; and at her death to be equally divided as the law directs. The balance of My estate, both real and personal to be sold and divided as above stated after paying my debts and deducting the within amounts out of each debtors legacy.

In the name of God Amen. I Nathan Magehee of the county of Jackson State of Georgia do make this my last will and testament in manner and form following.

I give my soul to almighty God,hoping for pardon for all of my sins, through the suffering of my Lord & savior Jesus Christ, & for my worldly estate which it hath pleased God to bestow on me, I do give in manner & form following.

I give to my son Nathan Magehee five shillings sterling with all that he has received of me to him and his heirs forever.

I give to my son Jesse MaGehee, one negro boy named Simon & eighty pounds to be paid in dollars at six shillings each to him and his heirs forever.

I give to my daughter Patsy MaGehee a negro, Peg & a fether bed, & a black horse, named Jack & eighty pounds to paid in dollars at six shillings each during her life & at her death to be equally divided between my four sons, Jesse,& Robert & Ozburn, & Solomon to them & their heirs forever.

I give to my son Robert MaGehee a negro man named Mat, & one feather bed & furniture, & eighty pounds to be paid in dollars at six shillings each to him and his heirs forever.

I give to my son Ozburn MaGehee a negro boy named Patton, & eighty pounds to be paid in dollars at six shillins each to him & his heirs forever.

I give to my son Solomon MeGehee a negro boy named Manchester & eighty pounds to be paid in dollars at six shillings each to him & his heirs forever.

I give to my son Mial Magehee five shillings to him & his heirs forever.

I give all the rest of my estate, be it of what kind or quality soever to be divided between my sons Jesse & Ozburn & solomon equally.

I do appoint my son Jesse Megehee & my friend John Sheppard to be executors of this my last will & testament. In witness whereof, I have set my hand & seal this 15th day of August 1803.

Know all men by these presents that we Birdey Hardy, Pyrant McGeehee, James Horn and Joel Bayless all of the state of Tennessee and county of Montgomery are held and firmly bound unto the govenor in and over the state, aforesaid or his successors in office in the just sum of four thousand dollars to be paid to the said govenor or his successors [in office] or their assigns which payment it well? and truly to be made we bind ourselves our heirs [executors]----- and administrators jointly and severally? firmly by these presents sealed with our state and dated this 22 days of April 1834. The condition of the above obligation is such that if the above bounders [sic] Bird Hardy and Pyrant McGehee-administrators of all and singular the goods and chattels and chattels rights and credits of Thomas McGehee deceased do make or cause to be made a true and perfect inventory of all and singular the goods and chattles and chattles rights and credits of the deceased which have or shall come into the hands knowledge or possession of said Bird Hardy & Pyrant McGehee or into the hands or possession of any other person or persons for him and the same so made to exhibit or cause to be exhibited unto our ensueing County court and the same goods chattels rights and credits and all other the goods chattels rights and credits of the deceased at the time of his death which at any time thereafter may come into the hands of any other person or person for him do well and truly administer according to law and further do make or cause to made a true and just account of the administration within one year after the date of these presents and all the rest and residue of said goods goods chattels and credits which may be found remaining on said administration account and the same being first examined and allowed agreeably to have shall deliver and pay unto such person or persons respectively as the same shall be due permanent to the true intent and meaning of this administration and if it shall appear that any will or testament was made by the deceased & executors or _____ thereto named do exhibit the same unto court making it allowed and approved of accordingly if the said Bird Hardy and Pryant McGehee thereunto the requested do ______ and deliver said letters of administrtion approbation of such testament bring first had and made in our said court then this obligatons then __________else to remain in full force and law.

In the Name of AlmightyGod, Amen:-
I William McGehee of the State and County aforesaid, being of good health and sound mind and memory- but knowing that it is appointed unto man once to die, and that life is uncertain; do make and ordain, this my last will and testament, my never dying soul, thru the mercy of God, and the merits of my adorable Saviour Jesus Christ to Almighty God, in humble hope that I shall be accepted of him.

In the next place it is my will and desire that all my just debts be paid out of my estate it is also my desire that my Executors hereinafter mentioned, cause to be selected by the court, five judicious, disinterested men to appraise all the property belonging to my estate, both real and personal and then sell and pay out of it the legacies for charitable purposes hereinafter named viz

First - I give and bequeath to the fund of special relief of the South Carolina Conference, to be received by the trustees of the said fund, to be dispered of in manner and form herein directed, that is, one third of the amount of the principal each year for three years, to the most needy according to the objects of said institution, the sum of six hundred dollars.

Second, - I give and bequeath to the offices and managers of the union school society of the aforesaid conference of the Methodist Episcopal Church, to be disposed of according to the constitution of said society, the sum of two hundred dollars.

3rdly - I give and bequeath to the offers and managers of the Missionary Society of the Methodist E.Church, to be disposed of according to the constitution of said Society,the sum of three hundred dollars.

4thly - I give and bequeath to the trustees of the Tabernacle Academy of Mount Ariel, which I understand to belong to the South Carolina Conference of the M.E. Church, to be disposed of by said trustees of aid in educating young men for the ministry and to aid in educating poor preachers children, the sum of two hundred follars.

5thly, I give and bequeath to the trustees of the chartered fund of the Methodist E. Church to be disposed of according to the constitution of said institution, the sum of two hundred dollars.

6thly - I give and bequeath to the stewards of the M.E. Church in Milledgeville Station for the education of the poor children in Baldwin County, to be disposed of by them and their successors in office, for the above purpose the sum of two hundred dollars.

7thly- It is my will that after the above legacies and my debts are paid, that my Executors cause an equal division of all the balance of my estate to be made between my beloved wife Catherine and my relations, embracing my brothers, sisters and their lawful heirs, excepting, three thousand dollars which I have already advanced to my wife's children [grandchildren in another transcription], William V. and Nathan McGehee to be reserved from the half to my wife and that amount to go to my relations as stated above.

The part of my property,as stated in the last item to go to my wife Catherine is to be at her exclusive disposal - and that part to be reserved for my relations to be equally divided between my brothers and sisters, John, Mary, Elizabeth, Micajah, Mumford, Daniel, Jacob, Samuel and Amra, and to be paid to them and their heirs, and I do here appoint my nephew William McGehee, the son of Samuel my brother deceased, my trustee to receive for the benefit of his mother and the children of the said Samuel the proportion to go to them which amount is to be enjoyed by the wife of my late brother Samuel - now Olive Rhods during her natural life, and then to go to the children of my said Brother Samuel and their heirs.

8thly- I do hereby appoint my worthy friends Thomas Foard, Lucius Q. C Lamar; and Henry W. Malone Esqus, my Executors to this my last Will.

In testamony whereof I have hereunto set my hand and seal this fourteenth day of August in the year of our Lord eighteen hundred and twenty seven.

It is further my will and desire that as my esteemed friend Thomas Foard has removed out of the County, and has become infirm, that William V. McGeheebe, and he is hereby appointed one of my Executors in the place of theafore said Thomas Foard.

To aforesaid children the testator give 50 pounds each to be paid to them at their respective age;

To wife Catherine McGehee full use of testator's land and plantation whereon he lives also the use of three negros and after paying debts and funeral expenses residue of household furniture and stocks of all kinds (except a young sorrel mare) and she is thereon to reaise my children and to give [them] four years schooling; land whereon testator now lives to the aforesaid children to be equally divided between them at the death of testator's wife, also 3 negros; the sorrel mare to be sold to the best advantage to pay executors.

1st I will that all my just debts be paid as soon as possible out of the sale of my crop and such of the stock as can be spared leaving a sufficiency of crop for a years provision with plantation utensils and for the support of my wife and family the remainder to be sold with two of my negroes(to-wit)Peter & Lizy if needed to pay my debts.

2nd I give my wife ANN MCGEHEE a bed & furniture with my silver table furniture my bureau & to do with as she pleases.

3rd I lend to my wife during her widowhood all the remaining part of my estate after my debts are paid & not heretofore divided giving the remainder to my children to build a house and cultivate such of my land as not to interfere with that of my wife may want to cultivate and educate my children JAMES ABRAHAM MCGEHEE& MARY LOUIZA MCGEHEE or the dwelling where I now live.

4th I give my daughter ELIZA ANN MCGEHEE a bed & stead and furniture, a sow & pigs which she has received also $8.00

5th I give unto my son JOHN WALKER MCGEHEE a bed & stead & furniture, a sow & pigs with $13.00 which he has received.

6th I give to my son JAMES ABRAHAM MCGEHEE when he arrives at the age of 21 a bed & stead & furniture & $13.00 with a sow & pigs

7th I give to my daughter MARY MCGEHEE when she arrives at the age of 21 years or marries a bed & furniture a sow & pigs a saddle & $13.00 my will is that at the death of my wife all of my estate thence remaining be equally divided between all my children.

It is my desire for the land to be valued by two disinterested men & if valued be more than five hundred pounds a piece for them to be accountable to the Estate for the over plus. Jacob & William to have two hundred & fifty pounds each in luo(sic) of land, which money is so(sic) be raised out of the profits of my estate when they become of lawful age.
Item 13. My daughter Judith Walton to have as much money as will make up twenty pounds with a parcel of Tobo., she has had. Mary Weaver & the four boys & Sarah C. McGehe are to be furnished with cow & calf one heifer two sows & piggs(sic) two ewes and lambs to each of them & if any of the negroes that are willed should die before the legatees comes to have them in possession they must have another of equal value. Martha Morton to have a Negro of Seventy pounds value which Negro with those I formerly lent to her at her death to be equally divided between her children.
Item 14th. I lend unto my wife Sarah McGehe after paying my just debts & the moneys given other above legatees all the balance of my estate not before given after her death to be equally divided between Elenor Pettus, Judith Walker, Mary Weaver,Jacob, William, Elijah & John McGehe Sarah C. McGehe. All that I have given I give unto them & their heirs forever & their increase & if any of my children should die before they come of age or marry that their parts should be returned into my Estate.
Item 16th And lastly I do appoint my friends William Walker, Thomas Pettus, Simon Walton and my son Jacob McGehe, executors to this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this seventeenth day of April one thousand eight hundred & six.

At a court held for Prince Edward County October the 20th 1806

The last will and testament of William McGehe dec'd was presented in court and proved by the oaths of george brooks and John weaver two of the witnesses thereto ordered that the same be recorded. On the motion of Thomas Pettus one of the executors therein named who with Thomas Clarke and Joseph Ligon his securities entered into and acknowledged their bond for that purpose in the penealy of thirty thousand dollars and conditioned according to law and took the oath required by law. Certificate for obtaining a probate thereof in due form is granted him and leave given the other executors therin named to take execution thereof at another day. And at another court held for said county March 21st,1814, On the motion of Simeon Walton one of the executors named un this will be entered into bond with Benjamin Hawkins, William McGehee and William Hamblen his securities in the penalty of ten thousand dollars conditioned according to law & took the oath required by law. Certificate for obtaining a probate thereof in due form is granted him.

I B. McGhee being of sound mind, but aware of the uncertainty of life, make this my last will and testament. All of my property real and personal I will be my beloved wife Mary K. Henly during her widowhood. In the event of her marriage, I wish my Said property equally divided between my wife and Surviving children that portion laid off to my wife to ____ to my children at her death. It is my desire that my negroes whom I view as human beings should be kept in the family during good behaviour and humanly _ealed; In order to do this I advise that they be placed on one of the farms and a Suitable person agent appointed to attend to them giving advice to induce some man fit to have the care of such business. It is my desire that my wife ____ to some suitable edifice on some one of the farms or elsewhere as she may choose taking with her such rewards as she may like so as to be free from the care and _____ attendent on the farm. It is further my desire that my wife in case she reamains a widow in case of the marriage or the coming of age of any of my children shall give such portion as may be fit taking into consideration of the size of the estate and having in view an equal final division of the said estate which final equal division I wish fanally to take place of all my wordly effects. Now in view of the extensive business of my near relations and their great care, I advise my wife to pay some suitable person at a stated Salary to wind up my Said estate to pay all debts collect all dues and to vest the surplus capital in good State Bonds or other good Safe securities so as the Said widow may have the least trouble with the same. It is further my desire that my children each receive the advantage of a first rate education to be drawn out of my estate every advantage which would con_____ to the Interest of their education.

I, James McGhee being of sound mind, .....etc. Item first to my beloved wife MARY McGHEE the house I live in with one third of the half lot of land on which the house is built to be taken off of said half lot of land so as to include the house and extend along the line of Robert McCamys land until it joines A. M. Turners land on the west during her lifetime and then to revert to my son ALBERT S. MCGHEE and I also will to my loving wife my oldest mare all my household furniture two cows and enough of hogs to raise her meat the balance of my stock I want sold and the proceds divided equally among my children. Item 2nd to my son ALBERT S. MCGHEE my half lot of land known as the east half of lot 282 in the ninth district and third section. Item 3rd to my son LARKIN and JAMES M. McGHEE my lot of land known as lot 295 in the ninth district and third section and also the remaining two thirds of the half lot or eighty of land on which I live after taking off one third for my wife as above described. Item 4th My two lots of land on Holly Creek known as lots 311 and 312 in the ninth district and third section to my son BURTON MCGHEE lawful heirs to be divided equally among them. Item 5th I also will and bequeath unto my grandson PLEASANT MCGHEE my young mare and a bridle and saddle to be worth twenty dollars and it is also my wish that he shall stay with the family and have land to work untill he shall be come of age or twenty-one years old if he shall choose to do so and have two cows. I John McGhee of the county of Monroe in the State of Tennessee being in good health and of perfect mind and memory and contemplating the certainty of death and the uncertainty of time and being desirous to dispose of my property do make and publish the following as my last will and testament.

Item 1. After my death I desire that my body shall be interred in a decent Christian manner at the discretion of my Executors.

Item 2. I desire that whatever just debts I may owe at the time of my death shall be promptly paid by my executors out of my estate.

Item 3. I give and devise to my daughter Margaret W. Humes all that portion of the tract of land lying in the county of Monroe called Calvin Smiths reservation . . .; also all the lands that I purchased of Louis Ross bying in Monroe County including a large island in Said Little Tennessee river called Ross Island, together with any lands adjoining said land purchased of Said Ross that I may own and all the lands that I may own that adjoins the Calvin Smiths reservation on the South West side of Said Tennessee River . . . All the above lands supposed to contain two? thousand and seven hundred and fifty five acres, more or less together with the _________ and ________ thereto belonging I give to my Said daughter during her natural life and at her death I give and bequeath the Said lands to the children of my Said daughter and their heirs forever, and should any of the children of my Said daughter die during her lifetime leaving children then the portion of Said deceased children and childrens shall go to their lawful heirs forever.

I also give and devise to my Said daugher Margaret W. Humes the following named Slaves, David?, Jack and Cruisanity? his wife and their four children Maria, Mary, Jim, and Mountiny? also Patinia and Nelson her Son, Mahala and her five Louisa, Samta Anna?, Andrew, Margaret and John, Susan and her three children . . . whose names are not now recorded, Peggy and her child Josephine, Charity? and her child Isabella, Lavinia, Jim's man? also Charles Lemuel and Tom. The above named slaves I give to my Said daughter together with their increase during her natural life and at her death I desire that said slaves with their increase shall go to the children of my Said daughter and their heirs and if any of Said children should die in the lifetime of their Said mother then I desire that the portion of Such deceased children or childrens shall go to their lawful heirs in the same manner of the above lands which I have given to my Said daughter. All the above named Slaves are now in the possession of my said daughter and it is my wish that Such of the children of any of the above slaves as may be born between this time and my death shall go with their mothers to my Said daughter in the Same way as their mothers. The above lands and Slaves I estimate to be worth forty thousand dollars five hundred dollars and in the division of my estate are to be ____ at that value to my Said daughter.

Item 4. I give and devise to my Son Barclay McGhee and his heirs foverever all that tract of land called the ______ Trail and which I purchased of Thomas H. Calloway . . . I also in like manner give to my Son all the land assigned in the upper divisions of _____ by a decree of the Ordinary Court at Madisonville made on the 19th day of September 1842 to Thomas L. McGhee John McGhee, Jr. and Mary Jones McGhee children and heirs of my brother Dr. Alexander McGhee deceased which said lots or divisions I now own having purchased the same together with all the balance of Said lands assigned to me by Said decree including all the land I hold in common at ____ with my Said brother Alexander McGhee and all lying partly in Blount and partly in Monroe counties. I also in like manner give to my Said Son a tract of land I own in Hamilton County lying at . . . containing seventy or eighty acres. I also in like manner give to my Said Son a tract of land in Blount County near Maryville containing about 615 acres and which tract was divided by the above mentioned decree between me and the heirs of my Said brother Alexander McGhee; and by said decree one half was assigned to Barclay McGhee one of the sons of Said Alexander McGhee and lying on the waters of ____ Creek adjoining the lands of Dr. Samuel Pride Ledford Duncan and others. I also give and bequeath to my Said Son and his heirs forever the following named Slaves viz Lewis & Julia his wife and their Six children, Caroline, Violet, Harvey, Sarah, Woods, ____, Jack and Dinah his wife and their Seven children Charles, Susan, Alexander, Hedy, Rhoda, Adaline, Florence, Ben, Martha, ____, ____, ____, Andy and Monroe Lucinda and Harriet, all of the above Slaves are now in the possession of my Said Son, and any children that may be born of any of Said Slaves between this time and my death, are also to go to my Said Son in like manner as their mothers. The above lands and Slaves . . . to be worth forty one thousand eight hundred dollars and in the division of my estate are to be rated at that valuation to my Said Son.

Item 5. I give and devise to my Son Charles M. McGhee and his heirs forever, ___ much of the tract of land known as the Calvin Smith reservation as lies South and West of Little Tennessee river and South and East of ___ river, making ____ river the line between him and my Said daughter margare W. Humes. . . I also give to my Said Son and his heirs forever a tract of Six hundred and forty acres lying in Monroe County on the Southwest side of Tennessee river and originally granted by the State of Tennessee to my father Barclay McGhee or to his divisee being the plantation on where I formerly lived, together with all the lands adjoining the Said Six hundred and forty acres tract that are not included in the devise to my Son Barclay McGhee lying in the fork between the rivers Tennessee and _____ and also . . . I also give to my Said Son Charles M. McGhee and his heirs forever the following named Slaves viz Vernon and his wife _ione and their Seven children Toby, Mary, Amanda, Eliza?, Ellen, Sophia & Monroe?, William and Margaret his wife and their five children Jade, _____, Henry, Leah, and ____, Rhoda and her four children, Henry, _ony, Isaac and Isabella, _____ and Sarah his wife, John, Peggy his wife and her child George. also Hugh Frank and S___wood. The above lands and Slaves I _____ to be worth forty thousand dollars five hundred sollars and in the division my estate are to be ruled at that value to my Said Son. The above named Slaves are now in the possession of my Said Son and it is my will that Such of the children of Said Slaves a may be born between this time and my death shall also go with their mothers to my Said Son.

Item 6. I give to my negro man james and to his wife Sally in consideration of their faithful Servitude their natural freedom and as soon after my death as my executors can make the arrangement I wish my executors to give the Said negroes James and Sally his wife eash a horse out of my stock and each a saddle and bridle which with the horses to be worth not more than seventy five dollars each, also to give to each of them a cow and calf out of my stock and also I give the Said James and Sally his wife each the Sum of five hundred dollars in money to be aid to them at Such times as their necessities may require they the Said executors being the entire Judges in what _____ Said money shall from time to time be paid. it is further my wish that Said negroes James and Sally have the possession and control of my two young negroes Barclay and Sandifer for Such length of time as my executors in their discretion may choose.

Item 7. I have given to each of my Said children heretofore the Sum of five thousand dollars in cash and cash notes together with the further Sum of two thousand dollars each in Stock making to each the Sum of Seven thousand dollars. It is my desire that in the division of my estate that they each be charged with that Sum as having been received by them and then that Such division of my estate by made as to give to each an equal portion of the Same valuing the property above devised to them at the valuation I have put upon the Same.

Item 8. All the residue of my property of every description _____ money and debts owing to me I give and bequeath to my said three children Margaret W. Humes, Barclay McGhee and Charles M. McGhee to be equally divided amonst them in Such manner as to make the share of each equal as I have before above directed.

Item 9. And I hereby constitute and appoint my Said two Sons Barclay McGhee and Charels M. McGhee my executors of this my last will and testament and are not required that they shall be held to Security by the county court as such but to act without Security.

Item 10. It is my desire that in the event of the Marriage of any of the children of my Said daughter Margaret W. Humes in the lifetime of their Said Mother that she have the power which I hereby give her; to give to Such child or children that may marry Such portion of the Slaves which I have given her as above, a_____ her discretion may choose haveing a . . .

I Matthew W. McGhee of ____ Monroe County Tennessee do make and publish this my last will and testament in manner and form following, that is to say

First - I give and bequeath to my brother in law William Lowry and his wife Polly and their heirs, one negro girl Esther and her children also Lydia & Ben children of my negro woman Jude.

Secondly - I give and bequeath to my nephew and niece William and Jane McDormott and their heirs my negro boy C___ his wife Abba and their children also Harriet, Washington and Emeline, children of my negro woman Jude.

Thirdly I give and bequeath to my niece Margaret M. McGhee my gold watch and chain, and lock? & key.

Fourthly, I give and bequeath to my brother, John McGhee all my notes of hand Securities for money or specific articles and book accounts, also my brass clock, two silver cups, six silver spoons, my riding mule and old bald horse.

Fifthly, I give and bequeath to my brother in law Thomas Henderson my young sorrel Dolin Mare

Sixthy. I give and bequeath to my brother Alexander McGhee my houses & lots on the East Side of Main Street in the town of Maryville, Blount County, Tennessee; also my small tract of land adjoining the Presbyterian burying ground near Maryville to him and his heirs forever.

Seventhly. I give and bequeath all the rest and residue of my estate both real and personal of whatsoever nature the ___ may be to my two brothers John McGhee & Alexander McGhee to be equally divided between them To have and to hold the same and . . . , in manner and form aforesaid to them and their heirs and assigns forever, charged with and liable to my just debt, and funeral expences.

Lastly I do hereby constitute and appoint my two brothers John McGhee and Alexander McGhee my executors of this my last will and testament; and do request and desire that they shall not be required to give any bond or security whatever for the execution of this my last will and testament. And do hereby revoke and declare null and void all former wills and testaments by me made.
