LAST WILL AND TESTAMENT OF ALFRED Ozment

In the name of God, Amen. I Alfred Ozment., being in good health and of sound and disposing mind and memory, calling to mind the frailty and uncertainty of human life, and being of a ------ of settling my worldly affairs, and directing how the estates with which it has pleased God to bless me, shall be disposed of after my decease, which I have strength and capacity so to do, do make and publish this, my last will and testament, hereby revoking and making nil and void all other last wills and testaments by me heretofore made.

And first., I commend my immortal being to Him who gave it, and my body to the earth to be buried with little expense or ostentation by my Executor herein after named. And as to my worldly estate,and all the property, real and personal, or mixed, of which I shall be seized and possessed, or to which I shall be entitled at the time of my decease, I divide, bequeath and dispose thereof in the manner following, towit:

First, my will is that all my just debts and funeral charges shall by my Executor herein after named, be paid out of my estate as soon after my decease as shall by them be found convenient.

Item 1st -- I give, devise and bequeath to my beloved wife, Nancy Ozment, my plantation, farming utensils, all my property., both personal and real, to hold and dispose of as she sees proper as long as lives, and after her decease, I give, devise and bequeath to my daughter, Josephine Ozment a tract or parcel of land ------ and described as follows, towit: The north west quarter of the north east quarter of Section thirty two (32) in Township fourteen (14) South of Range Eight (8) west containing forty (40) acres, the remainder of my property I want to be divided in six equal shares. I want the heirs of William 0. Ozment to have one share, to be equally divided among them by my executor herein after named. I want the heirs of Robert S. Ozment to have one share to be divided among them in the same manner, share and share alike. I want the heirs of Elizabeth Ann Ozment among them in like manner., share and share alike. I want the heirs of my daughter, Susan Jane Jordan to have one share to be divided among them in like manner, share and share alike. And I want my daughter Josephine Ozment, to have one share. And lastly, I do nominate and appoint Levy B. White to be my executor of this my last Will and Testament.

In testimony whereof, I the said Alfred Ozment, have to this my last 'Will and Testament., contained on two pages of papers subscribed my name and affixed my seal, this the 17th day of June in the year of our Lord, one thousand, eight hundred and seventy-two.

The following is the will of James Henry Ozment, Jr. as taken down by Lamar Hayes White of Midvale, Utah (Sent to me by Lon Martin):

WILL OF JAMES OZMENT
In the name of God Amen, I James Ozment of the County of Drew and State of Arkansas, being of sound mind and memory and considering the uncertainty of this frail and transisting life, do therefore make, ordain publish and declare this to be my last will and testament. That is to say:

First, after all my lawful debts are paid and discharged, the residue of my estate, real and personal I give, bequeath and dispose of as follows: To wit.,

To my sons John A. and Joseph, all my land belonging or joining the tract upon which I now reside by lying on the east bank of Saline River in the county of, Drew and State of Arkansas, also two beds and bedding belonging to the same.

To my son James G., forty acres of land lying in the northern part of section Eleven Township Fifteen, south of Range Nine west.

To my niece Sarah Franklin., one bed and bedding belonging to the same. To the heirs of William Ozment, Elizabeth Cornish, John A, James G. Ozment and Robert C. Ozment one trunk of ??? (coins and ???)

The residue of my estate, both real and personal to be sold and the proceeds to be divided equally between all my children or their heirs.

Likewise, I make, constitute and appoint my son, John A. Ozment, to be my executor of this my last will and testament.

In testimony whereof, I have hereunto subscribed my name and affixed my seal the 19th day of September in the year of Christ one thousand eight hundred and sixty one. James OZMENT

The within instrument was subscribed by the said James Ozment in our presence and acknowledged by him to each of us and he at the same time published and declared the within instrument so subscribed to be his last will and testament and at the testators request and in his presence have signed our names as witnesses hereto and written opposite our names, our respective places of residence.

Be it remembered that on this 20th day of January A.D. 1662, before me Samuel Gibson, clerk of the circuit court and exofficio clerk of the court of Probate, for and within said county of Drew and State of Arkansas, appeared John A. Ozment (by Henry H. Crook) and exhibited a certain instrument of writing perporting to be the last will and testament of James Ozment, deceased-----[END]

Talbot County - Mary Osment made oath on the Holy Evangels of Almighty God that this a a just and perfect Inventory of all and Singular the Goods and Chattels which were of the deceased John Ozment that came to her Hands at the time of the making thereof and that of what hath since or shall hereafter come to her Hands or possession she will return in an addl. Inventory That she knows of no Concealment of any Part or Parcel Thereof by any Persons whomsever and that if she shall discover any Concealment or Suspect any to be she will acquaint the Commissioner General for the time being or his Deputy with such Discovery or Cause of Suspicion that it my be enquired into and that she will well and truly give a just account of all and every part of the deceased's personal Estate that shall hereafter come to her hands possission or knowledge before me August 21st 1752.
